Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of Scale With TD (the "Service"), operated as Scale With TD ("we," "us," "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you don't agree, don't use the Service.

Scale With TD is a tool that generates video production assets — including scripts, voice narration, captions, scene breakdowns, visual prompts, and images or video clips — from a topic and configuration you provide. Some or all output is generated using third-party AI models; see Section 7.

You must provide accurate information when creating an account and are responsible for keeping your login credentials secure. You're responsible for all activity that happens under your account. Tell us immediately if you suspect unauthorized access.

You must be legally able to enter into a binding contract to use the Service. If you're using it on behalf of a company or organization, you're confirming you have authority to bind that entity to these Terms.

The Service is offered under Free, Starter, Pro, and Agency plans, with pricing and included usage as displayed in the app at the time of purchase. Paid plans renew automatically at the start of each billing period unless cancelled beforehand.

Static image generation is bundled into paid plans at no separate charge. Animated video clip generation is metered: each plan includes a starting credit bundle, and usage beyond that is charged per clip at the rate shown before generation.

Cancelling a subscription stops future renewals; you retain access through the end of the period already paid for. Credits already consumed by a completed generation are not refundable, as they reflect compute cost already incurred. If you believe you were billed in error, contact us and we'll review it.

You agree not to use the Service to generate, publish, or distribute content that is illegal, infringes on someone else's rights, is defamatory, or is intended to deceive, harass, or harm others. You also agree not to attempt to circumvent usage limits, reverse-engineer the Service, or use it to build a competing product from scraped output.

We reserve the right to suspend or terminate accounts that violate this section, with or without notice, at our discretion.

You own the scripts, voice narration, captions, images, and video clips generated from your projects, subject to the terms of the underlying third-party AI providers described in Section 7 and any rights held by those providers in their models. You're responsible for how you use and publish generated content, including compliance with the platform (e.g. YouTube) you publish it to.

We don't claim ownership over your generated content. You grant us a limited license to store and process your project data solely to operate and improve the Service.

Generation is performed using third-party AI providers (including but not limited to Google's Gemini and Stitch, and providers you configure such as ElevenLabs or OpenAI). We don't control these providers' models, uptime, or output quality, and we make no guarantee that generated content will be accurate, error-free, or continuously available. Provider outages or changes may affect the Service's availability or output.

The Service itself — its software, design, branding, and underlying technology — is owned by Scale With TD and protected by applicable intellectual property law. Nothing in these Terms grants you rights to the Service beyond what's needed to use it as intended.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that generated content will meet your expectations.

To the maximum extent permitted by law, Scale With TD will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access if you violate these Terms, or discontinue the Service, in whole or in part, at our discretion with reasonable notice where practical.

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date below. Continuing to use the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Principality of Monaco, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Monaco.
